This bill, titled the "Freedom to Farm Act," establishes new regulations for adults in Tennessee regarding marijuana. It defines terms such as "marijuana," "cultivate," and "mature plant" to clarify what is covered under the act. The bill permits registered adults to cultivate up to fifteen marijuana plants, with a maximum of five mature plants, in a private, secure, and non-publicly visible area of their residence. They are also allowed to cure, possess, and store the resulting marijuana, with a limit of sixteen ounces of dried marijuana trim stored in a locked container or room, and to use marijuana trim and related paraphernalia. Additionally, registered adults can casually exchange marijuana trim without payment with other adults on their property, provided the marijuana remains on the premises, and can purchase marijuana seeds. Importantly, the act explicitly excludes resin, concentrates, and oils from these provisions, which remain subject to existing laws. Adults registered under this act must prevent minors from accessing cultivation or storage areas and cannot use or exchange marijuana in their presence. Registration with the department of agriculture is required, costs $100, is valid for three years, and is needed for only one adult per residence, with all household adults considered registered for that property. A portion of the registration fees, after administrative costs, will fund a farmers' market support program starting in 2027. The bill takes effect for rule promulgation upon becoming law and for all other purposes on January 1, 2027.
