This bill, known as the "Tennessee Fair Chance Housing Act," aims to prevent housing discrimination based on an applicant's criminal history by establishing specific rules for "housing providers" (landlords, property managers, etc.) when considering an applicant's "criminal history" (arrests, charges, or convictions). Generally, housing providers are prohibited from refusing to rent or discriminating based on criminal history, and they cannot ask about arrests that didn't lead to a conviction. However, they can consider misdemeanor convictions within three years and felony convictions within ten years of the application date, with specific exceptions for sex offense convictions which can be considered without a time limit if an "individualized assessment" is conducted and a direct relationship to safety is established. This individualized assessment requires a written evaluation of factors like the offense's nature, time elapsed, applicant's age, evidence of rehabilitation, and the relationship between the offense and community safety. If a housing provider denies housing based on criminal history, they must provide written notice within seven business days, detailing the conviction, the assessment, and the applicant's rights to submit additional information. The Department of Correction will also implement an education program to inform individuals with criminal convictions about their rights.
