However, these restrictions do not apply to the off-duty conduct of employees or to speech and actions protected by the First Amendment of the U.S. Constitution. The bill establishes a private right of action, allowing citizens, residents, or taxpayers to sue individuals or entities that violate these provisions, with successful plaintiffs potentially receiving declaratory and injunctive relief, damages including for emotional distress, and attorney's fees, and it specifies that various common legal defenses are not applicable in such lawsuits.
