This bill makes it illegal for homeowners' associations (HOAs), which are organizations that manage or regulate residential subdivisions, to enforce restrictions against operating a licensed family child care home or group child care home on a property. A "family child care home" and "group child care home" are defined by state law and refer to places where children are cared for in a home setting. If an HOA violates this provision, they could be liable for actual damages and up to $1,000 in punitive damages. Additionally, landlords are prohibited from refusing to rent to someone or making a dwelling unavailable because the tenant operates or plans to operate a licensed family or group child care home. However, landlords can require tenants operating these homes to provide notice of licensing, maintain adequate liability insurance, add the landlord as an additional insured on their policy, get permission for structural changes, and follow reasonable restrictions on the use of shared spaces in multi-family properties. Landlords who willfully violate these provisions are also subject to actual and punitive damages. These new rules apply to declarations and rental agreements created or amended after the bill becomes law.
