Bill Summary

As enacted, authorizes all bonds for the conveyance of real or personal estate to be registered only if the bond contains the signatures of all parties subject to the bond and the expiration date of the bond; authorizes all agreements for the conveyance of real property or contracts, memoranda, abstracts, or affidavits for the sale of real property, or similar documents by whatever similar or other name, to be registered if such documents contain the signature of the owner of the property or the owner's attorney-in-fact or court-appointed representative, the signature of the proposed purchaser, and the expiration date of the agreement. - Amends TCA Section 66-24-101.

AI Summary

This bill amends Tennessee Code Annotated, Section 66-24-101, which governs which documents can be officially recorded, or "registered," in Tennessee. The key change is that agreements related to the conveyance of real property, along with any related notices, affidavits, memoranda, or abstracts, can now be registered if they are authenticated, meaning their signatures are verified according to a specific legal process outlined in § 66-22-101, and they clearly state an expiration date including the day, month, and year. This aims to clarify and expand the types of agreements that can be officially recorded, ensuring that such documents are properly signed and have a defined end date. Additionally, any affidavits presented for registration must be sworn to before a notary public and include specific language confirming this oath.
