This bill requires the Tennessee Department of Education to officially opt-in to a federal program that offers a tax credit to individuals who donate to organizations that provide scholarships. Specifically, the bill mandates that the state participate in the federal tax credit established under Section 70411 of Public Law No. 119-21, which is designed to encourage private contributions to scholarship-granting organizations. To facilitate this, the Department of Education will be responsible for creating and annually submitting a list of eligible scholarship-granting organizations located in Tennessee to the U.S. Secretary of the Treasury, and will also publish this list on its website. The department must also certify its authority to submit this list and accept new organizations for consideration throughout the year, ensuring Tennessee is eligible for this tax credit program for taxable years beginning after December 31, 2026, and importantly, no state government department, agency, or board can create a rule to implement this section.
