This bill creates a new offense in Tennessee law that makes it illegal to knowingly inhale, ingest, use, or possess any compound, liquid, gas, or chemical containing nitrous oxide, also known as "laughing gas," or amyl nitrite, commonly called "poppers" or "snappers." A violation of this new law is classified as a Class A misdemeanor, and a judge may require offenders to participate in a drug rehabilitation program as a condition of probation. However, the bill outlines several exceptions where possessing and using nitrous oxide is permitted, including when prescribed by a licensed medical or dental practitioner for treatment, as part of a manufacturing or industrial process, as a propellant in food preparation for restaurants, or for automotive purposes. The bill also makes it illegal for any person or business, including online retailers, to produce, sell, or transfer nitrous oxide for illegal use, and businesses found in violation will face suspension of their licenses for the first offense and revocation for a second offense. This legislation is set to take effect on July 1, 2026.
