This bill streamlines the process for scheduling certain medications as controlled substances in Tennessee, specifically those approved by the U.S. Food and Drug Administration (FDA). It establishes that if the FDA approves a substance and it's designated or scheduled under federal law, and no objection is raised in Tennessee within 30 days of the federal order's publication, the substance will automatically be placed in the same federal schedule of controlled substances in Tennessee. This automatic scheduling takes effect immediately after the 30-day period and bypasses the need for annual state schedule revisions for these specific FDA-approved substances. Furthermore, the bill allows licensed healthcare prescribers, such as doctors, to immediately prescribe these newly scheduled drug products upon their effective date, provided the drug is FDA-approved, not in Schedule I (which contains the most dangerous drugs with no currently accepted medical use), within the prescriber's scope of practice, and not otherwise prohibited by law.
