This bill clarifies the process and consequences when a county or a group of municipalities (referred to as a municipal solid waste region) fails to comply with their approved solid waste management plan, as established by the Solid Waste Management Act of 1991. It defines noncompliance as failing to submit a proper plan on time, having a submitted plan rejected by the commissioner (the head of the relevant state agency), not following an approved plan, or generally not adhering to the law. The bill outlines a series of escalating sanctions: initially, a warning letter will be issued with an offer of technical assistance. If the issue isn't resolved within 30 days of the warning, the noncompliant region becomes ineligible for funds from the solid waste management fund, which includes grants and rebates, unless the commissioner grants an extension due to special circumstances. If noncompliance persists for 60 days after the warning, the commissioner can impose daily civil penalties of up to $5,000. Furthermore, until the noncompliance is fixed, the state's overall solid waste management plan will be imposed on the noncompliant region.
