These alternative methods include "construction manager at-risk," where a construction manager acts as the general contractor and provides a guaranteed maximum price, and "design-build," which combines design and construction services under a single contract. To utilize these methods for "qualified local projects" (construction projects costing over $5 million), local governments must have a full-time purchasing agent, select parties through a competitive proposal process with specific disclosure requirements for evaluation criteria and committee members, and have established policies authorizing such processes. The bill also defines "competitive proposal process" to include public disclosure of evaluation criteria, transparency in selection committee composition and conflicts of interest, prompt notification of selections with scores, a protest mechanism for proposers, and public access to all procurement documents. This legislation is intended to provide supplemental authority for eligible local governments to manage their construction projects more effectively.
