This bill enhances penalties for individuals convicted of driving while intoxicated (DWI), specifically targeting repeat offenders and those with prior serious driving-related convictions. It amends existing laws concerning second, third, and fourth or subsequent DWI offenses to include stricter sentencing. For a second DWI offense, if the first offense was vehicular homicide, third-degree feticide, or first-degree vehicular negligent injuring (or an equivalent offense in another state), the minimum prison sentence is increased to two years, with at least one year served without parole, probation, or suspension of sentence. For third or subsequent DWI offenses, if the offender has prior convictions for vehicular homicide, third-degree feticide, or first-degree vehicular negligent injuring (or equivalent), the penalties are significantly increased, with longer mandatory prison terms and no possibility of parole, probation, or suspension of sentence. The bill also introduces new provisions for fourth or subsequent offenses, imposing a minimum of twelve months imprisonment without benefit of parole, probation, or suspension, and prohibiting concurrent sentencing with prior offenses. In all these enhanced penalty scenarios, the vehicle used in the offense may be seized and sold.
