This bill requires the state engineer to conduct a comprehensive study on the impacts of "consumptive water use," which is defined as using water in ways that prevent its return to the natural water cycle, such as through electrolysis or as a feedstock for hydrogen fuel production, and also includes large-scale industrial water use. The study will specifically examine the effects of water use by data centers, carbon capture technologies, and hydrogen production, excluding normal evaporation from irrigation or reservoir operations, and will analyze current water use and its impact on other users, recommending ways to limit future impacts on all beneficial uses, including municipal, agricultural, and recreational needs. The findings and legislative recommendations are to be reported to a legislative committee by November 1, 2026, and the state engineer's office is appropriated $500,000 from the general fund to carry out this study, with any unspent funds reverting by June 30, 2027.
