This bill, by adding new sections to the Health and Safety Code and the Insurance Code, aims to give licensed healthcare professionals more flexibility in adjusting prescription drug dosages for patients without requiring prior approval from their health insurance plan or health insurer, known as utilization review. Specifically, if a patient has been continuously using a drug for a chronic medical condition or cancer treatment that was previously approved, and the drug is not an opioid or controlled substance, the healthcare professional can adjust the dose or frequency up to two times without needing prior authorization. Furthermore, if a patient has been consistently taking a prescribed drug for their condition under their current or a previous health coverage, their current plan or insurer cannot limit or exclude coverage for that prescription. This change is intended to ensure patients receive the most effective treatment for their specific medical needs.
