This bill requires that all sales or transfers of firearms, even those conducted online, must be processed through a licensed firearms dealer, meaning someone who holds a valid federal firearms dealer license and any other required state or local licenses. This applies to individuals, corporations, and other entities, with specific exceptions for law enforcement officers acting in their official capacity, members of the Armed Forces or National Guard, federal officials performing official duties, gunsmiths receiving firearms for service or repair, common carriers or warehousemen handling firearms in the ordinary course of business, and transfers between close relatives. If neither the buyer nor the seller is a licensed dealer, they must use a licensed dealer to facilitate the transaction, who will then conduct a background check and comply with all federal, state, and local laws as if they were the seller, potentially charging administrative fees of up to $35 for a single firearm or $50 for multiple firearms. This also applies to trustees or personal representatives transferring firearms to heirs or devisees, who must use a licensed dealer to facilitate the transfer, with options for the heir or devisee to transfer to another eligible individual, sell to a dealer, or have the dealer sell the firearm on their behalf. Violations are considered a class B misdemeanor, with repeated violations treated as separate offenses, and licensed dealers found in violation will have their transactions reported to the Attorney General and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
