This bill establishes a process for recalling certain elected officials or individuals appointed to fill vacancies in South Dakota, excluding those subject to impeachment. To initiate a recall, a petition must be signed by fifteen percent of the registered voters in the relevant jurisdiction, based on the number of registered voters at the last general election, and signatures are only valid if gathered within sixty days of filing. The petition must include the signer's residence, the date of signing, and specific grounds for removal, such as crime, drunkenness, gross incompetency, malfeasance, or misconduct. The State Board of Elections will create rules for the petition's form. After filing, the petition can be challenged in court, and if deemed valid by the secretary of state, a special election will be held within sixty days, unless the petition is filed close to a regularly scheduled election, in which case it will be included in that election. The recalled official can be a candidate in the special election, and if they win or if no other candidates are nominated, they remain in office. If a successor is elected, they will serve for the remainder of the unexpired term.
