This bill amends Idaho law to revise the conditions under which homicide is considered justifiable, specifically by expanding the scope of individuals for whom defense can be legally undertaken. Previously, justifiable homicide in defense of another was limited to specific familial or employer-employee relationships like defending a wife, husband, parent, child, master, mistress, or servant; this bill broadens that protection to include the defense of "another person" generally, provided there is a reasonable fear of a felony or serious bodily injury and imminent danger of it occurring. The bill also clarifies definitions for "habitation," "place of business or employment," and "vehicle" in the context of justifiable homicide, and includes a presumption that someone unlawfully and forcefully or stealthily entering such a place intends to commit a felony. Finally, the bill declares an emergency and sets an effective date of July 1, 2026.
