This bill amends existing law to allow a defendant who wins a lawsuit for libel, slander, invasion of privacy, or similar torts to recover damages, including potentially triple the amount of damages, plus attorney fees and court costs from the person who sued them. This recovery is only possible if the lawsuit was based on a statement made by the defendant that was factually true, made without malice (meaning without intent to harm or with reckless disregard for the truth), and concerned an incident of sexual assault, sexual harassment, or unlawful discrimination that the defendant personally experienced. The bill clarifies that a single publication, like one edition of a newspaper or one broadcast, can only be the basis for one lawsuit.
