This bill requires any entity that owns, leases, operates, controls, or supervises a building, structure, facility, or installation that emits or may emit an air pollutant (referred to as an "owner or operator") to make all emissions records they are legally required to maintain publicly available and accessible on their own website starting January 1, 2028. These records must be in a downloadable digital format and updated on the same schedule they are provided to the state or federal government, with some exceptions for records provided more frequently than monthly. The bill also clarifies that "confidential business information" can be redacted from these public records, and these requirements apply only to records generated on or after December 1, 2027. This legislation stems from concerns about air pollution in Colorado and a finding by the U.S. Environmental Protection Agency that Colorado's previous practices did not sufficiently allow public access to emissions information needed to ensure compliance with the Clean Air Act. The bill also modifies how civil penalties collected for violations are distributed, allocating funds for the implementation of these new public accessibility requirements and for the Motor Vehicle Emissions Assistance Fund.
