Bill Summary

AN ACT To amend Article 8 of Chapter 11 of Title 9 of the Official Code of Georgia Annotated, relating to provisional and final remedies and special proceedings, so as to prohibit as contrary to the public policy of this state any contract or agreement that has the purpose or effect of concealing the details relating to a claim of childhood sexual abuse; to provide for the confidentiality of identifying information of victims of childhood sexual abuse; to provide for a short title; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

AI Summary

This bill, known as "Trey's Law," amends existing Georgia law to declare that any contract or agreement, including settlement agreements or employment agreements, that prevents the disclosure of acts of childhood sexual abuse or related facts is void and unenforceable as it goes against the public policy of the state. While such agreements cannot hide these specific details, they can still keep other aspects of a settlement, like the amount paid, confidential. This change applies to agreements made before, on, or after the law takes effect, but a person seeking to enforce such a confidentiality clause must first obtain a final court ruling confirming its enforceability.
