This bill, titled the "Trade Cheating Restitution Act of 2026," modifies how interest earned on certain antidumping and countervailing duties is described and allows for a special distribution of these funds. Antidumping duties are taxes imposed on imported goods sold at less than their fair market value, while countervailing duties are imposed on imported goods subsidized by their country of origin. The bill amends the Trade Facilitation and Trade Enforcement Act of 2015 to change the starting date for when U.S. Customs and Border Protection collects these duties, moving it back to October 1, 2000. Crucially, it also authorizes a special distribution of all interest earned on these duties for fiscal years ending before the bill's enactment. To be eligible for this special distribution, individuals or entities must have previously received a distribution under the Continued Dumping and Subsidy Offset Act of 2000, file a timely certification, and meet the original eligibility requirements of that act. The collected interest will be grouped by the specific duty order and then distributed proportionally to eligible recipients, with different timelines for interest earned after October 1, 2010, and interest earned between October 1, 2000, and September 30, 2010.
