This bill amends existing Maine law concerning noncompete agreements, which are contracts that prevent an employee from working for a competitor or starting a competing business after leaving their current employer. Specifically, it defines "health care practitioner" as anyone licensed to provide healthcare services in Maine and adds a provision that any enforceable noncompete agreement between an employer and a health care practitioner must respect a patient's right to choose their own healthcare provider. The bill also clarifies that these rules apply to health care practitioners employed by an entity in which they have no ownership stake, and it removes a previous distinction that treated allopathic and osteopathic physicians differently regarding the effective date of noncompete agreements, now applying the same rules to all health care practitioners. These changes will affect noncompete agreements made or renewed on or after the bill's effective date.
