This bill, titled the Data Center Construction by Foreign Adversaries Act, prohibits any "foreign company" from building a data center in Illinois unless specific conditions are met. A "foreign company" is defined as an entity that is at least 51% owned by a "foreign adversary" (a term defined by federal regulations, 15 CFR 791.2) or is headquartered in a country whose government is considered a foreign adversary. Before construction can proceed, the Illinois Commerce Commission, the Illinois Power Agency, and the Department of Commerce and Economic Opportunity must jointly study the projected energy usage of the data center. They must then certify to the Governor and the General Assembly that the energy required for the data center will be self-generated and will not negatively impact the electricity supply managed by PJM (PJM Interconnection, LLC) or MISO (Midcontinent Independent System Operator, Inc.), which are regional organizations responsible for managing the electricity grid.
