This bill amends existing Alabama law to clarify the powers of boards of water and sewer commissions, specifically concerning public recreational use of water bodies they control. The primary change is the addition of a new subsection (c) that restricts these boards from prohibiting or limiting public recreational activities on water bodies they own or manage, unless they can demonstrate a substantial public interest requiring such restrictions at a public hearing, with advance public notice. However, boards can temporarily restrict access for up to 90 days without a hearing if an emergency necessitates it, but must then hold a public hearing. Any such restrictions or closures can be appealed to the circuit court. This new provision applies only to navigable waterways within 50 miles of the Gulf of America that serve as sources of drinking water. The bill also makes minor technical edits to the existing language detailing the general powers of these boards, such as their ability to adopt bylaws, sue and be sued, acquire property, issue bonds, fix rates, and enter into contracts.
