This bill, effective January 1, 2029, amends the Illinois Pesticide Act to prohibit the sale, use, or distribution of corn, soybean, or wheat seeds treated with pesticides containing neonicotinoids, which are a class of insecticides, unless a waiver is obtained from the Department of Agriculture. To receive a waiver, which is valid for a maximum of two years, farm owners must complete integrated pest management training, conduct a pest risk assessment, ensure treated seeds are planted only on specified properties, and maintain records of these assessments and planting dates, all subject to review by the Department. The Department of Agriculture, in consultation with the Department of Natural Resources, will establish rules for this waiver process and must report annually to the General Assembly on the number of waivers granted. Violators face civil penalties, with fines increasing for subsequent offenses, but are not subject to other criminal or civil penalties outlined in the Act for this specific violation. Additionally, the Department of Natural Resources and the Department of Agriculture, in collaboration with the University of Illinois, are directed to study and report on alternatives to neonicotinoid pesticides by January 1, 2029.
