Bill Summary
AN ACT To amend Code Section 50-18-72, relating to when public disclosure not required, so as to provide for an exemption from disclosing audio and video recordings captured by law enforcement when such recordings depict a person's death; to provide for exceptions; to provide for related matters; to repeal conflicting laws; and for other purposes.
AI Summary
This bill amends existing law to create an exemption from disclosing audio and video recordings made by law enforcement officers when these recordings depict a person's death, show a person in distress just before death, or include audio, video, or images of a deceased person, provided that disclosure would be an invasion of personal privacy and there is no pending investigation. However, this exemption does not apply if a court orders the disclosure or if specific individuals, such as a deceased person's estate representative, a minor's parent or guardian, a criminal defendant or civil litigant who believes the recording is relevant to their case, or an attorney representing any of these individuals or a potential civil litigant, submit a sworn affidavit confirming their eligibility to receive the recording.
