This bill revises provisions related to student scholarship organizations in Georgia, primarily by expanding eligibility for scholarships and adjusting rules for scholarship amounts. Specifically, it waives the requirement for students to have attended a Georgia public school for at least six weeks if their parent is an active-duty military member stationed in Georgia, or if the student has an Individualized Education Program (IEP) or a Section 504 Plan, or has been diagnosed with certain disabilities like dyslexia, autism spectrum disorder, speech-language delay and disorder, hearing loss, or other intellectual and developmental disabilities (IDD) designated by the Department of Education. The bill also clarifies that the maximum scholarship amount a student scholarship organization can award annually is generally capped at the average state and local expenditures per student in public education, unless the student has an IEP, Section 504 Plan, or a diagnosed disability as mentioned above. The bill also updates the percentage of donated revenue that student scholarship organizations must obligate for scholarships, with higher percentages required for larger amounts of revenue. This legislation is set to become effective and apply to taxable years beginning on or after January 1, 2026.
