This bill aims to phase out the use of per- and polyfluoroalkyl chemicals (PFAS), a group of man-made chemicals known for their persistence in the environment and potential health risks, in various products sold in the state. Starting on specific dates, manufacturers will be prohibited from selling certain products that intentionally contain PFAS, including cleaning products, cookware, cosmetics, personal care products, feminine hygiene products, juvenile products, intimacy products, fabric treatments, ski wax, textiles, textile furnishings, upholstered furniture, and paint. The bill also establishes registration requirements for manufacturers of products containing intentionally added PFAS, mandating them to submit disclosure forms and pay a registration fee to the state by January 1, 2028, with exceptions for certain uses deemed "currently unavoidable" by the Department. Furthermore, the bill mandates testing of products to ensure compliance and outlines penalties for violations, with collected fees and penalties contributing to a dedicated Maryland PFAS Chemicals Protection and Remediation Fund to support efforts in assessing, preventing, and cleaning up PFAS contamination.
