AN ACT to amend the mental hygiene law, in relation to duties of providers of services for the developmentally disabled

This bill mandates that providers of residential services for children and adults with mental or physical disabilities, as well as facilities providing residential care to youth that are operated, licensed, or certified by the Office of Children and Family Services, must install electronic monitoring devices with sound capability in all public common areas, including living areas, dining areas, hallways, classrooms, and time-out rooms, and post conspicuous notices informing individuals that video and sound are being captured. Additionally, in residential facilities for children with mental disabilities, residents or their parents/guardians may, at their own expense, install and operate an electronic monitoring device in a single-occupancy bedroom, provided they notify the facility and post a notice if audio is being captured, with failure to comply resulting in a daily fine of one thousand dollars.
