Bill Summary
Amends the Local Governmental and Governmental Employees Tort Immunity Act. Includes "medical examiner's office" and "coroner's office" within the definition of "medical facility" in Article VI covering Hospital and Public Health Activities. Provides that nothing in the Act exonerates a public employee or medical facility from liability for injury proximately caused by any negligent or wrongful conduct, act, or omission, in the handling, identification, disposal, or treatment of a deceased human, or exonerates a local public entity whose employee, while acting in the scope of his or her employment, so causes such an injury. Applies only to causes of actions accruing on or after the effective date of the amendatory Act.
AI Summary
This bill amends the Local Governmental and Governmental Employees Tort Immunity Act, which provides protections to local government entities and their employees from lawsuits. Specifically, it expands the definition of "medical facility" to include "medical examiner's office" and "coroner's office" when discussing hospital and public health activities. Crucially, the bill clarifies that these protections do not shield a public employee or a medical facility from liability for injuries caused by negligent or wrongful actions or omissions related to the handling, identification, disposal, or treatment of a deceased human body, nor does it shield the local government entity if its employee causes such an injury. These changes apply only to legal claims that arise on or after the bill becomes law.
