This bill amends existing Idaho law to revise how counties and cities can regulate short-term rentals, which are properties rented out for less than 30 days. It clarifies that local governments cannot outright ban these rentals but can implement reasonable regulations to protect public health, safety, and the character of residential neighborhoods. Short-term rentals will be treated as residential land use for zoning purposes. The bill also specifies that local governments cannot regulate the online platforms where these rentals are advertised. Importantly, a license or permit to operate a short-term rental can only be required if the owner has four or more such properties in the jurisdiction or if a single rental generates $10,000 or more in gross annual revenue. Owners of rentals not meeting these criteria can be required to register annually and provide a local contact person. The bill outlines specific safety regulations that can be imposed, such as requiring smoke alarms, carbon monoxide detectors, maximum occupancy limits, and providing emergency contact information. Any other regulations must not be more restrictive than those applied to long-term rentals or other residential uses. The bill also includes an emergency clause, making it effective on July 1, 2026.
