This bill amends Wyoming law to clarify that the destruction of water molecules, specifically by separating hydrogen and oxygen atoms for the industrial production of hydrogen, is not considered a beneficial use of water. This means that applications for water use permits that involve this process will be rejected, particularly if the water source has been subject to priority regulation or interstate compacts within the last ten years. An exception is made for the appropriation of by-product water. The bill also specifies that existing water rights issued before July 1, 2026, will not be interpreted to allow this type of water destruction unless explicitly permitted under prior law, and these new provisions will apply to all new water permit applications filed on or after July 1, 2026.
