AN ACT To amend Subpart 2 of Part 6 of Article 6 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to conditions of employment, so as to provide that teachers shall not be required to supervise students during their duty-free lunch period or planning period except in cases of extreme emergency; to require that teachers who supervise students during their duty-free lunch period or planning period are compensated in cases other than an extreme emergency; to provide that requirements related to duty-free lunch periods and planning periods for teachers shall not be subject to waiver; to provide for definitions; to provide for an effective date and applicability; to provide for related matters; to repeal conflicting laws; and for other purposes.
AI Summary
This bill clarifies that teachers in Georgia are generally not required to supervise students during their duty-free lunch period or planning period, which are designated times for teachers to rest or prepare for instruction without direct student responsibility. The bill defines an "extreme emergency" as a severe situation like natural disasters, school attacks, or significant transportation disruptions, and explicitly states that a lack of substitute teachers does not qualify as an extreme emergency. If a teacher is asked to supervise students during these periods for reasons other than an extreme emergency, they must be compensated at an hourly rate consistent with their salary. Furthermore, the bill stipulates that these requirements for duty-free lunch and planning periods cannot be waived by schools or school systems, ensuring these protected times are upheld.
