This bill imposes a temporary halt, or moratorium, on the issuance of permits for new data centers, which are defined as facilities capable of using twenty megawatts or more of electricity primarily for data processing, storage, or related services. This moratorium will remain in effect until the Department of Environmental Conservation (DEC) issues regulations to mitigate the environmental impact of data centers and the Public Service Commission (PSC) takes required actions. The DEC will prepare a comprehensive study, known as a generic environmental impact statement, examining data centers' effects on electricity and gas consumption, water usage, land use, pollution, and electronic waste, and will then issue regulations based on this study. Concurrently, the PSC will produce a report on how data centers affect electricity and gas rates for residential, commercial, and industrial users, and within three years of the bill's enactment, the PSC will issue orders to minimize these rate impacts, ensuring that data centers bear the costs associated with their energy consumption and infrastructure needs.
