This bill, known as Trey's Law, creates a new section of Kentucky Revised Statutes (KRS) Chapter 372, which deals with contracts against public policy. It defines "act of sexual abuse" broadly to include various forms of sexual offenses and exploitation as outlined in existing KRS statutes, as well as "grooming behavior" directed at a minor to establish an emotional connection for future sexual conduct. The core provision declares void any nondisclosure agreement (NDA), confidentiality agreement, or similar provision within any contract that prevents the disclosure of an act of sexual abuse or related facts, regardless of whether criminal charges or convictions resulted. However, this does not prevent parties from agreeing to keep other aspects of a settlement, like payment amounts, confidential. Importantly, this law is retroactive, meaning it applies to agreements made before its effective date, but any party wishing to enforce such an older agreement or provision must first obtain a final court order (a declaratory judgment) confirming its enforceability.
