This bill, titled the "Fair Rental Agreement Act," makes several changes to Arizona's residential landlord and tenant laws. It requires landlords to provide tenants with at least nine months' notice before increasing rent if the tenant has a lease of one year or more or has been a tenant for at least one year. The bill also clarifies procedures for handling a tenant's property and pets if the tenant dies or becomes incapacitated, including requiring landlords to attempt to contact an authorized person designated by the tenant. For prospective tenants, landlords are prohibited from charging for a credit report or background check if the tenant provides their own, and can only charge the actual cost of any screening process, with no separate application fee if screening costs are already covered. Landlords also cannot charge more than one rental application fee per year and cannot charge an additional fee for payment processing methods like online portals or automatic withdrawals. Additionally, landlords must now disclose the exact amount of periodic rent and any mandatory fees or expenses, along with their due dates, on the first page of the rental agreement and in advertisements. Finally, violations of these landlord-tenant laws are now considered consumer fraud and are subject to enforcement under existing consumer protection statutes.
