This bill, effective October 1, 2026, aims to strengthen consumer protections when purchasing used motor vehicles by requiring dealers to provide warranties on vehicles less than ten years old. Specifically, dealers will no longer be allowed to disclaim or limit "implied warranties," which are unwritten guarantees that a product is fit for its intended purpose, on these younger vehicles. Furthermore, contracts for the sale of used cars under ten years old must now include an "express warranty," a written guarantee, stating the vehicle is mechanically sound and will remain so for at least sixty days or three thousand miles, whichever comes first, unless damaged by an accident or misuse. The bill also clarifies that a used car can only be sold "as is," meaning with no warranty, if it is ten years old or older.
