This bill requires motor carriers transporting agricultural commodities within Arizona for commercial purposes, but not for farm-to-field operations, private hauling by farmers, or involving non-commercial vehicles, to carry liability insurance sufficient to cover emergency towing and recovery services. This insurance can be either cargo insurance for the agricultural commodity or a surety bond or other financial security approved by the department. If a towing or recovery operator provides these services and is not paid, they will have a lien on the commercial motor vehicle and the agricultural commodity belonging to the motor carrier, which can be perfected by recording a notice with the secretary of state, and a release must be recorded upon satisfaction of the lien. "Agricultural commodity" is defined as a farm product transported for commercial purposes, and "emergency towing and recovery services" includes towing, recovery, cleanup, and related services requested by law enforcement or public authorities.
