Bill Summary

AN ACT To amend Part 4 of Article 6 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to financing relative to the "Quality Basic Education Act," so as to prohibit virtual instruction to out-of-system students if the local school system has a College and Career Ready Performance Index below the state average; to require an agreement between local school systems to allow for an out-of-system student to attend a virtual school; to require out-of-system students to not be counted toward equalization funds received by a local school system; to provide for an effective date; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill, effective July 1, 2026, amends Georgia law to prohibit local school systems from providing virtual instruction to students who live in another school system (referred to as "out-of-system students") if that local school system's College and Career Ready Performance Index (CCRPI), a measure of school performance, is below the state average from the previous academic year. To allow an out-of-system student to attend a virtual school, the student's home school system and the virtual school's system must first enter into an agreement. Furthermore, these out-of-system students will not be counted when calculating the enrollment numbers that determine if a local school system qualifies for equalization funds, which are financial supplements designed to help schools with fewer resources. Virtual instruction, as defined by this bill, refers to online learning for kindergarten through 12th grade, excluding programs offered by the Georgia Virtual School, a state clearinghouse, or state charter schools that provide virtual instruction.
