AI Summary
This bill, known as the Georgia Cannabis Freedom and Integrity Act, aims to create a regulated cannabis market in Georgia by establishing a Georgia Cannabis Commission to oversee licensing, regulation, and public health standards for cultivation, manufacturing, testing, and sales. It defines key terms like "cannabis," "decriminalization" (reducing penalties for small amounts to civil infractions), "industrial hemp" (cannabis with very low THC), and "legalization" (removing criminal penalties and establishing a regulated market). The bill allows adults 21 and older to possess up to two ounces of cannabis and cultivate up to three plants for personal use, and expands medical cannabis access to include all products recommended by a physician for qualifying conditions. A 15 percent state excise tax will be imposed on cannabis sales, with revenue allocated to public health programs, the Department of Revenue, a social equity fund for communities harmed by past prohibition, and the state's general fund. Driving under the influence of cannabis remains illegal, public consumption is prohibited, and cannabis products must be sold in child-resistant packaging with clear labeling and warnings, with the commission empowered to enforce these regulations through fines or license revocation. The bill also revises existing law to make possession of two ounces or less of marijuana a misdemeanor, and authorizes counties to adopt ordinances for possession of two ounces or less of marijuana in unincorporated areas, punishable by fines.
