This bill modifies the criteria for determining if an incarcerated person with a severe mental health disorder requires mandatory mental health treatment as a condition of parole. Previously, a chief psychiatrist had to certify that the prisoner met all of several specific conditions, including having a severe mental health disorder, the disorder not being in remission without treatment, the disorder contributing to their criminal behavior, having received 90 days of treatment within the year prior to parole, and posing a substantial danger of physical harm to others. This bill changes the requirement to needing to meet only three of these five criteria, and it explicitly includes sexual harassment and battery under the definition of "physical harm" for the purpose of this assessment.
