This bill, known as Miranda's Law or the Miranda Vargas School Bus Driver Red Flag Act, mandates the creation of a national employer notification service by the Federal Motor Carrier Safety Administration (FMCSA), a division of the Department of Transportation. This service will automatically inform employers about significant changes to an employee's driving record or license status, such as moving violations, suspensions, or revocations, for individuals holding a commercial driver's license (CDL). The FMCSA is required to issue a final regulation within one year of the bill's enactment, considering recommendations from the American Association of Motor Vehicle Administrators (AAMVA) and the results of a past pilot program. States will then have two years to implement this service, which will be integrated into the CDL program's requirements. Notably, employers with employees holding a CDL with a school bus endorsement must participate, and schools and school districts will be considered employers if they arrange or pay for student transportation. Participating employers will be exempt from certain annual driving record review requirements, and employees will receive simultaneous notification whenever their employer is informed of a driving record change.
