This bill prohibits individuals convicted of certain offenses, including those involving child abuse or neglect within the past seven years, from administering a home-based educational program, which is defined as educational instruction provided to a child by a parent, legal guardian, or their designee in compliance with state requirements. It also prevents individuals under investigation for child abuse or neglect from starting a home-based educational program for a child if they have been advised not to do so by child protective services, though those already administering such a program before an investigation began are allowed to continue. The bill clarifies that the Department of Family Services or local law enforcement is responsible for enforcing these new provisions related to criminal background checks and abuse investigations, and anyone violating these rules faces felony charges. Additionally, existing home-based educators who are in violation of the new criminal background provisions will have until July 1, 2026, to cease administration.
