This bill expands an existing procurement program—which previously applied only to counties for construction projects exceeding $1,000,000—to now allow cities and the San Gabriel Valley Council of Governments (a regional government agency representing multiple cities in Los Angeles County) to use a "best value" construction contracting method for projects exceeding $500,000, meaning contracts are awarded based on a combination of price and qualifications rather than the lowest bid alone. Under this process, participating local governments must evaluate bidders using objective criteria such as financial condition, relevant experience, management competency, labor compliance, and safety records, while ensuring that cost information is hidden from the evaluation committee until qualifications are scored. To ensure accountability, the legislation requires participating entities to follow strict prequalification procedures under oath, mandate a skilled and trained workforce (or operate under an approved project labor agreement), limit contract retention proceeds to five percent when surety bonds are used, receive at least three responsive bids before awarding a contract, and submit a comprehensive report on their projects to the state Legislature before March 1, 2031. Finally, the bill extends the sunset date for the entire best value contracting program by two years to January 1, 2032, and includes legislative findings explaining why a special statute is uniquely necessary for the infrastructure and housing projects managed by the San Gabriel Valley.
