This bill, the Western Joshua Tree Conservation Act, expands the ability of cities to authorize the removal of western Joshua trees for commercial and industrial projects, in addition to existing provisions for counties and cities to do so for single-family residences, multifamily residences, accessory structures, and public works projects, provided certain conditions are met, such as limiting the number of trees taken and ensuring proper mitigation or fee payments. Furthermore, it allows homeowners to remove western Joshua trees within a specified distance of their existing single-family residence or accessory structures, or within the construction footprint of a new accessory structure, and allows developers of public works projects to remove trees within their construction footprint, all without requiring fees or further mitigation, provided they submit a permit request with specific information to the Department of Fish and Wildlife, which must then approve or deny the request within 60 days.
