This bill shifts the responsibility for hearing appeals related to certain certification decisions from the Deputy Secretary of the Department of Military Affairs and Public Safety, or their designee, to the Office of Administrative Hearings, which is an independent body that conducts hearings and makes decisions on behalf of government agencies. Specifically, it clarifies that the Office of Administrative Hearings will now handle appeals from individuals who have been denied entry into law-enforcement certification programs, trainees who are not allowed to continue in training, officers whose applications for certification reactivation are denied, or officers or instructors whose certifications are denied, suspended, or decertified by the Law-Enforcement Professional Standards Subcommittee, which is a part of the Governor's Committee on Crime, Delinquency and Correction. Additionally, the bill expands the jurisdiction of the Office of Administrative Hearings to include appeals from decisions or orders of any subcommittees of the Governor's Committee on Crime, Delinquency and Correction.
