Bill Summary

This bill implements requirements related to the health instruction and health education instruction provided to students enrolled in school districts, charter schools, and innovation zone schools in grades 1 through 12. The bill provides that, in addition to the requirements related to the health and health education instruction described in Code section 256.11 (educational standards), each school district, charter school, and innovation zone school shall require that the health and health education instruction provided to students enrolled in grades 1 through 12 include active participation in a program that satisfies requirements established in the bill. Those requirements provide that the program must include evidence-based instruction related to proper nutrition and aerobic exercise; be aligned with health standards adopted by the department of health and human services; provide a passing or failing grade to each student upon completion of the program; be selected from nationally accepted nutrition and aerobic exercise programs designed for school-age children; include testing of blood pressure and resting heart rate; include assessments of each student’s strength endurance; include modified tests for exceptional students; provide teachers with access to turnkey, evidence-based nutrition and aerobic exercise education; allow time during the school day for students to meet state physical activity requirements; and fill out a daily journal. The bill authorizes school districts, charter schools, and innovation zone schools to issue a request for proposals and enter into an agreement with a qualified person to provide all or part of the program. Any agreement entered into pursuant to the bill’s provisions must utilize a per-student rate for the cost of the qualified person’s services. School districts, charter schools, and innovation zone schools are required to report certain specified information to the department of education related to student assessments and tests administered as part of the program, and the department of education is required to submit an annual report to the general assembly that contains information related to the results of those assessments and tests. The bill provides that all information collected from students participating in the program shall be kept confidential. The bill requires the state board of education to adopt rules to administer the bill’s provisions. The bill may include a state mandate as defined in Code section 25B.3. The bill requires that the state cost of any state mandate included in the bill be paid by a school district from state school foundation aid received by the school district under Code section 257.16. The specification is deemed to constitute state compliance with any state mandate funding-related requirements of Code section 25B.2. The inclusion of this specification is intended to reinstate the requirement of political subdivisions to comply with any state mandates included in the bill.

AI Summary

This bill mandates that all school districts, charter schools, and innovation zone schools in grades one through twelve must implement a comprehensive health and health education program that goes beyond existing educational standards. This program requires active student participation and must include evidence-based instruction on proper nutrition and aerobic exercise, covering topics like nutrients, reading nutrition labels, and the link between diet, exercise, and heart health. Students will receive a passing or failing grade for the program, and assessments will be conducted at the beginning and end of terms to measure their knowledge and physical fitness, including blood pressure, resting heart rate, and strength endurance, with modified tests for exceptional students. The program must be selected from nationally recognized curricula, and teachers will receive training materials. Schools are required to allocate time during the school day for physical activity and for students to maintain a daily journal tracking their food and exercise. Districts have the option to contract with qualified external providers for all or part of the program, with costs based on a per-student rate. All collected student data will be kept confidential, and schools must report assessment and test results to the department of education, which will then submit an annual report to the general assembly. The state board of education will establish rules to implement these provisions, and any costs associated with these new state mandates will be covered by school districts using their state school foundation aid.
