Bill Summary
This bill relates to statutory corrections that adjust language to reflect current practices, correct grammar, insert earlier omissions, delete redundancies and inaccuracies, resolve inconsistencies and conflicts, remove ambiguities, and establish Code editor directives. Section 4.1A: Adds commas to enhance readability of the provisions relating to the construction of statutes with regard to the terms “sex”, “gender”, and related terms. Sections 8.3 and 8.22: Replaces “legislature” with “general assembly” to conform with preferred term usage throughout the Code. Section 8.57A: Strikes two obsolete paragraphs relating to appropriations made for fiscal years 2010-2011 through 2012-2013. Section 9F.6: Replaces reference to “decennial federal census” with “federal decennial census” to conform with the preferred term usage throughout the Code. Adds serial commas and revises language to enhance readability. Section 12.51(2)(b)(2)(a): Corrects a cross reference to a provision regarding appropriation of certain opioid litigation settlement moneys for certain fiscal years. Section 12.51(2)(b)(4): Removes an unnecessary portion of a cross reference in a provision regarding certain uses of opioid litigation settlement moneys. Sections 15.274 and 15.436: Removes an unnecessary portion of a reference to the “economic development authority” because “authority” is a defined term under Code chapter 15. Section 16.230: Adds an unnumbered paragraph to denote a list of definitions and specifies that the definitions apply only within the particular subchapter part of Code chapter 16. Section 28E.9: Revises language relating to joint governmental agreements to enhance readability. S.F. _____ Section 49.128: Reorganizes and redesignates paragraphs to remove a permissible state commissioner of elections rulemaking provision relating to additional certifications from a list of items required to be certified and filed by the county commissioner of elections following an election. Section 84A.1B: Changes reference from “the subsection” to “this subsection” to reflect the correct section subunit under which the specified list is submitted by community colleges. Section 99G.31: Modifies language in two locations to align with preferred style and to enhance readability in a provision relating to the lottery. Section 123.31C: Modifies language to eliminate passive voice and to enhance readability of a provision relating to authorizations under a special class “C” retail native wine license. Section 135C.2(6): Revises language relating to residential care facilities to correct grammar. Sections 135C.2(8) and 135C.6(10): Adds language to specify that these provisions are effective upon passage of federal legislation in accordance with 1996 Iowa Acts, chapter 1053, section 3. Such effective date information was previously only included in a footnote to those Code sections. Section 135C.24: Revises language to enhance readability and adds serial commas to several lists within the Code section relating to health care facilities. Section 135H.5: Corrects grammar for certain application and licensing fees related to psychiatric medical institutions for children. Section 148.6: Changes an internal reference from “this subsection” to “this section” to reflect the proper scope of the provisions that specify the grounds for disciplining a licensee of the board of medicine. Section 169.13: Adds a comma to a provision relating to the practice of veterinary medicine to align with preferred style and improve readability. S.F. _____ Section 187.201: Changes reference from “this subchapter” to “subchapter III” to correctly identify the subchapter under which the specified choose Iowa programs are created. Section 187.331: Modifies an internal reference to subchapter III, part 1, to clarify that the reference occurs within that subchapter rather than that part. Section 189A.2: Revises an internal reference to clarify that the subparagraph being referenced is the subparagraph in which the reference occurs. Section 200.3(5): Changes “a” to “an” to correct grammar. Section 200.3(22): Adds a serial comma to a list within the definition of “nuisance action or proceeding”. Section 200.6: Changes “manufacturers” to “manufacturer’s” to properly reflect the usage as possessive. Section 200.10: Modifies language governing the duties of the secretary of agriculture relating to fertilizers and beneficial substances to enhance readability. Section 203.1: Strikes an unnecessary cross reference within a definition of “bond”. Section 203D.1: Removes unnecessary commas to enhance readability within a definition of “seller”. Section 203D.6: Adds “the” as the definite article before the word “time” to correct grammar and to enhance readability. Section 217.4: Adds commas to set off a clause within a sentence and to enhance readability. Section 217.31: Adds a serial comma to a list within a provision relating to actions for damages. Section 225.2: Replaces reference to “it” with specific identification of and cross reference to the state psychiatric hospital. Section 225.3: Replaces reference to “said hospital” with specific identification of the state psychiatric hospital. Section 225A.3: Changes a cross reference relating to agency strategic plans from “8E.206” to “8E.204”. Code section 8E.206, relating to agency strategic plans, was repealed by S.F. _____ 2024 Iowa Acts, chapter 1082, section 14. Section 231.4: Strikes the definition of “equivalent support” from the Code section because the term is not used in the Code chapter. Section 232.77: Adds a serial comma to a list of entities in a provision relating to certain medical tests. Section 237.9: Adds a comma to set off a clause within a sentence and to enhance readability. Section 237A.5: Replaces “which” with “that” to correct grammar in a provision relating to child care facility personnel. Section 249A.26: Changes “mental health and disabilities services” to “mental health and disability services” to align with the preferred usage of that phrase. Sections 252E.2, 252E.6, 252E.7, and 252E.9: Strikes unnecessary commas to enhance readability. Section 256.11: Strikes an outdated provision relating to employment contract compliance until June 30, 2011. Sections 256.189 and 256.191: Revises internal references to part of a subchapter to conform with preferred reference style. Section 256.192: Switches the order of subsections 8 and 9 and revises an internal reference to part of a subchapter to conform with preferred reference style. Section 256.194: Changes a cross reference from “subsection 8” to “subsection 9” to reflect the bill’s amendment to Code section 256.192. Section 256.212: Revises an internal reference to part of a subchapter to conform with preferred reference style. Section 256.216: Changes “private institutions” to “accredited private institutions” to conform to the defined term applicable to the Code section. Section 805.8A: Revises a list of cross references to align with the preferred style for such references. 2025 Iowa Acts, chapter 27, section 4: Amends an Iowa Acts provision to align with an editorial change made during codification of 2025 changes to Code section 724.22. To align with the defined term within Code chapter 260C, unless the context otherwise requires, the bill directs the Iowa Code editor to replace references to the “department of education” with “department” throughout Code chapter 260C. To conform with other references throughout the Code, the bill directs the Iowa Code editor to replace references to “decennial federal census” with “federal decennial census” throughout Code section 423.3.
