This bill modifies the rules for holding primary elections, which are preliminary elections used to narrow down candidates before a final election. Specifically, it changes the conditions under which a primary election is authorized for new municipalities and special districts. For new municipalities, a primary election will now only be held if it is not prohibited by another section of law and if the number of candidates for an office is more than twice the number of positions available. For special districts, a primary election can only be held if the special district board authorizes it and if the number of candidates exceeds twice the number of positions to be filled. The bill also makes minor adjustments to the wording regarding when candidate filing deadlines are extended and clarifies that a primary election for a municipal office requires authorization from the municipal legislative body. This bill takes effect on May 6, 2026.
