This bill, by amending Section 40.1-5-41 of the General Laws concerning the Mental Health Law, extends the same immunity from liability currently afforded to physicians and surgeons to advanced practice registered nurses (APRNs). This means that APRNs, like physicians and surgeons, will generally not be held accountable in court for their actions or decisions made during proceedings under this chapter, unless there is evidence of actual fraud or gross, willful, or wanton negligence. This protection also extends to any damages or injuries that may arise from a patient exercising their rights under the Mental Health Law, even if those actions go against the advice of the APRN. The bill takes effect immediately upon its passage.
