This bill amends existing Idaho law, specifically Section 22-112 of the Idaho Code, to formally integrate provisions related to agricultural product promotion and certification, including the creation of "certificates of free sale." A certificate of free sale is defined as a document issued by the Department of Agriculture certifying that a product is grown or processed in Idaho, distributed within the state, and complies with Idaho's health and sanitary laws. This new provision allows exporters to apply for these certificates to meet requirements in other countries, with a fee not exceeding $100, and requires exporters to provide health inspection records. The bill also makes a technical correction by changing "under" to "pursuant to" in relation to organizations authorized to promote or regulate agricultural products. Crucially, this bill declares that certain administrative rules currently found in IDAPA 02.01.05, which govern certificates of free sale, will become void on July 1, 2026, effectively replacing them with the provisions now incorporated into the Idaho Code. The bill includes a severability clause, meaning if any part of the act is found invalid, the rest will remain in effect, and it specifies an effective date of July 1, 2026.
